Welcome to Yacht Connect. These Terms of Use govern your access to and use of our platform, websites, and services. By accessing or using Yacht Connect, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, booking a charter, or simply browsing the Yacht Connect platform, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you may not use our services.
2. User Accounts
To access certain features of Yacht Connect, you must register for an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for safeguarding your password and account credentials.
- You must promptly notify us of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
3. Booking & Payments
Our platform facilitates the booking of yachts and related experiences between owners and guests.
- Service Fees: Yacht Connect may charge service fees for bookings made through the platform. These fees will be displayed before checkout.
- Payments: All payments are processed securely. You agree to pay all charges associated with your booking, including taxes and fees.
- Security Deposits: Owners may require a security deposit, which will be specified at the time of booking.
4. Cancellations & Refunds
Cancellations and refunds are governed by the specific cancellation policy selected by the yacht owner at the time of booking.
- Guests must review the cancellation policy before confirming a booking.
- Yacht Connect service fees are generally non-refundable unless stated otherwise.
- In the event of weather-related cancellations or force majeure, refunds or rescheduling will be handled in accordance with our standard weather policy.
5. Owner Responsibilities
If you are listing a yacht on our platform, you agree to the following:
- You are legally authorized to charter the vessel and possess all necessary licenses and permits.
- Your vessel meets all local safety, maritime, and insurance requirements.
- Your listing accurately reflects the condition, location, and amenities of the yacht.
6. Guest Responsibilities
If you are booking a yacht as a guest, you agree to the following:
- You will respect the vessel, the captain, and the crew.
- You will adhere to the maximum passenger limits and boarding rules specified by the owner.
- You are responsible for the actions and behavior of all members in your party.
- Any damage caused to the vessel by you or your party may be deducted from your security deposit or billed directly to you.
7. Limitation of Liability
To the maximum extent permitted by law, Yacht Connect and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform or any services booked through the platform.
Yacht Connect merely acts as an intermediary facilitating bookings and takes no responsibility for the condition of vessels, the actions of captains, or the behavior of guests.
8. Prohibited Conduct
You agree not to engage in any of the following activities on the platform:
- Using the platform for any fraudulent or illegal purpose.
- Bypassing the platform to negotiate bookings outside of Yacht Connect to avoid service fees.
- Harassing, threatening, or discriminating against other users.
- Interfering with the proper functioning of the platform or its security measures.
9. Termination
We may terminate or suspend your access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the service will immediately cease. Sections relating to Limitation of Liability, Governing Law, and Payment Obligations shall survive termination.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Yacht Connect is headquartered, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that region.
